Program terms

We would like to inform you that some corrections have been made to the revised terms and conditions published on March 3, 2023 in the program terms and conditions comparative table:

  • There are no changes to article 17;
  • Article 34 (arbitration) is deleted;
  • Only articles 34 and 35 posted in the above table are added to the "General" section.

Current members who do not agree to the new terms may cancel their membership without penalty no later than 30 days after the launch of the revised terms by following the cancellation steps in effect when requesting to cancel their membership (see section 33 of the program terms and conditions).

1. The Moi Program (“Program”) is the property of Metro Inc. (" Metro ").

2. All Program members ("members") must be 16 years old or older and reside in Canada.

If you are under the age of majority in the province in which you reside, you must obtain the consent of your parent or legal guardian if such consent is required in the province in which you reside.

3. Only one valid card (Moi card, key tag, mobile app card or in any other form specified by Metro ("card(s)") per member.

When you allow the use of your card by other persons, you agree that such persons may: (i) redeem the accumulated points, (ii) update the information related to your account, (iii) link the card or the membership number to other programs and services offered by Metro, the Participating Banners and their partners. In addition, when your card or membership number is linked to a digital account, the personal information provided when creating the digital account or as updated afterwards is considered a correction and update of your personal information and is retained for the administration of the Program and our communications with you. Metro and the Participating Banners are not responsible for validating with you any points redemption and any updates of personal information made by persons who use your card or membership number.

4. The card is not a credit card. It is the property of Metro.

5. The Program is available at banners, stores, establishments and web sites of the Metro group (" Participating Banners ") and participating partners’ establishments and web sites.

Metro may remove or add Participating Banners and participating partners. You can visit the web site moiprogram.ca for a full list of Participating Banners and participating partners.

6. Only natural persons may participate in the Program; corporations, companies, joint ventures, partnerships, groups and associations are excluded.

7. Accumulated Program points cannot be transferred, converted into cash or sold. Points can be accumulated and redeemed on presentation of the card or by using the membership number when applicable. When available, Metro may, at its sole discretion and with the member’s express consent, authorize the i) transfer of accumulated points to another member’s account, and/or ii) donation of accumulated points to a charity.

8. Program members must advise Metro of any changes in their personal information. Metro reserves the right to cancel the membership to the Program with incomplete or incorrect member information. Moreover, Metro will have no obligation to redeem accumulated points or communicate any information or notice to a member who did not provide its personal information or an update of such or duly complete and submit the enrollment form (see Section 31).

9. Members are responsible for reporting lost or stolen cards to Metro. Accumulated points will be maintained and a new card issued. Metro shall not be liable for any transactions before it was notified of a card’s loss or theft.

Point Accumulation

10. To earn points, members must present their card at the cash or use the membership number on the Participating Banner’s web site or participating partners as Metro may designate from time to time. When making a purchase at a Participating Banner, if they’ve forgotten their card at the time of making the purchase, members need to get the bill stamped or initialled at the courtesy counter of the store before leaving the store. Members have 14 days to return with their card and stamped or initialled bill to the store’s courtesy counter to get their point balance adjusted. Only stamped or initialled bills will be accepted.

There may be a delay of a business day before the accumulated points are made available on a member’s account.

11. No points are awarded for purchases of the following products and services: tobacco products, lottery tickets, public transportation tickets and passes, gift cards and other prepaid cards, stamps, postal services, dry cleaning, film and video game rentals, any deposit fees and eco-contributions, SAQ products, alcoholic beverages outside of the province of Québec, order preparation and delivery charges, donations, utensils for ready to eat products, certain products offered on participating partner’s platforms, products offered through food waste reduction platforms, Fragrance Discovery Gift Sets, items linked to a fundraising campaign, prescription drug, other medication and other pharmacy or health care-related products and services according to laws in place in each province, taxes, ecofees and any items excluded by Metro in the future or forbidden by law. Excluded products may vary by province and Metro reserves the right at all times, to add or exclude, at its sole discretion, eligible items for points.

12. Points accumulate at the rate of 1 point per dollar spent on an eligible purchase at Participating Banners, except if a Participating Banner is not authorized to award points. Members may visit the web site moiprogram.ca for the full information on how to earn and redeem accumulated points.

Points are calculated on the total net amount before taxes shown on the sales slip. For promotional offers, the Participating Banners may offer bonus points with the purchase of certain products.

Points will be issued to a Metro gift-card holder who uses it to pay for his/her purchases.

13. Points are awarded only once per transaction based on the total net amount before taxes of purchases and any promotions in effect. In the case of products sold by weight, members may not split their transaction.

14. Product returns are handled according to each Participating Banner’s and each participating partner’s product return and exchange policy. Metro reserves the right to subtract the points earned on the returned product’s purchase or a promotion involving said product, whether the purchase was made in-store, online or at a participating partner.

If a member returns a product purchased at a Participating Banner or a participating partner, Metro may, at its sole discretion, deduct from the member’s account the number of points earned for that product purchase. In such case, the member’s account balance may become negative depending on the number of points that are available on the member’s account.

Points redemption

15. Members may redeem accumulated points when making a purchase at a Participating Banner in increments of 125 points provided they have a minimum of 500 points in their account.

Members may not redeem points of an equivalent amount of more than $200 per transaction and $500 per day.

Coupon rewards that are not redeemed before April 27, 2023 will be added to the member’s account in points available for redemption. Until rewards in the form of coupons are no longer accepted, more than one coupon may be used for the same transaction.

The form of the reward is determined by Metro and may change during the Program.

16. Points will be converted as follows: 125 points = $1 or as otherwise determined by Metro in accordance with the present terms and conditions. There is no maximum reward.

17. Upon conversion, the points required (500 points, plus each additional 125 points) for the maximum applicable reward under the Program are deducted from the member's account. Unused points remain in the account and count for the next qualification period.

18. Members who did not accumulate the minimum points required (500 points) cannot redeem accumulated points until they have accumulated the minimum points required.

19. To start redeeming points, members must complete and submit their subscription form duly completed. To redeem accumulated points, members must present their card at a Participating Banner’s store or use the membership number when making an online purchase on a Participating Banner’s web site or follow whatever other procedures as may be determined by Metro from time to time.

20. The pre-tax value of a transaction must be equal to or greater than that of the points being redeemed.

21. More than one reward coupon may be used for the same transaction before April 27, 2023 at Metro and Metro Plus participating stores in Québec. Awarded rewards in the form of coupons that are not redeemed before April 27, 2023, will be added to the member’s account in points available for redemption.

22. 23. The terms and conditions of the Program coupons are on the coupons or in their accompanying documentation. Unless otherwise specified, Program coupons are cumulative so that a member may use more than one coupon in a single transaction. Subject to their terms and conditions of use, Program coupons (paper or digital) may be applied once to a transaction by a member making purchases in store or online at a Participating Banner. However, certain Program coupons are reusable and are clearly identified as such. Use of accumulated points and Program coupons in a transaction made online is subject to the e-commerce terms of use provided on said website. In the event of conflict between the terms and conditions provided on Program coupons and these terms and conditions of the Program, the terms and conditions provided on Program coupons shall prevail.

24. Metro may, from time to time and at its sole discretion, partner with various businesses of its choice to offer additional Program offers, additional points, and joint promotions and offers. Metro may, at its sole discretion, offer personalized promotions, promotional activities, contests or others exclusively to certain categories of members. The details, terms and conditions of such promotions and joint promotions and offers will be communicated to members.

Other benefits

25. Besides Program points, coupons and rewards, members benefit from exclusive member prices, personalized prices, where applicable, on specially selected products and other limited benefits. To take advantage of these exclusive prices and limited benefits when available, members must present their card at the cash, before the transaction ends, when making a purchase at a store or web site of a Participating Banner. Exclusive member prices are indicated in store on the selected product price cards and online when applicable.

Trademarks

26. The Moi Program is a trademark of Metro. This trademark and any other trademark used by Metro, by a Participating Banner or displayed in any communication or on their Internet sites cannot be used without the prior written authorization of their respective owners.

Program Electronic Communications

27. Members may receive Program-related electronic communications which may include or refer to Program updates, services, offers and promotions, and surveys. These communications may also include, or refer to, offers and promotions of participating partners. Members may also receive the Program’s weekly electronic newsletter. All such electronic communications are sent by Metro and the Participating Banners and members can withdraw consent to receive them at any time. Members who want to receive electronic communications or withdraw their consent to receive them are invited to visit the web site moiprogram.ca or Participating Banners’ web site or mobile application.

Should Metro note a fault in or problem with a member’s account or should Metro need to communicate information regarding the account, including the Program’s terms and conditions’ updates, Metro may communicate electronically with said member to remedy the problem or fault affecting the member’s account or communicate the information regarding the account. These communications are exempt from the federal legislation against spam and unsolicited emails.

Any required notice pursuant to these terms and conditions or by law will be sent to the member’s email address or as required by law.

Accuracy

28. All necessary measures were taken to ensure the accuracy of the information in these terms and conditions. Metro rejects all liability arising from any error or omission. Please see the latest version of these terms and conditions at: moiprogram.ca. In the event of a conflict between the Program terms and conditions on the enrollment form and the Program terms and conditions provided online at moiprogram.ca, the latter shall prevail.

Modifications to the Program

29. Metro may at any time:

(a) modify any of the terms and conditions including the following: conditions of eligibility for members and accounts; conditions applicable to product purchases and transactions under the Program, exchanges and eligible types of products; coupons, rewards, notably their form, frequency of issuance and redemption mechanisms; conditions covering point accumulation by members; terms applicable to the conversion of points into rewards; the expiration of points, conversion factor used for converting points into rewards, Participating Banners, participating partners or venues at which points rewards may be accumulated or redeemed, joint offers and promotions with participating partners; and make any other modifications required under legislation or regulations; which modifications shall not apply to points accumulated prior to the effective date of the aforementioned modifications; and

(b) publish all modifications to the Program on its web site at the address stated above and/or send a written notice to its members when required and in the form required by law. The member who maintains its membership to the Program following its modification is deemed to have accepted the modifications; and

(c) refuse to issue a card to a customer who does not follow the established registration procedures.

30. Metro reserves the right to terminate the Program upon advance written notice to Program members under the manner required by law. Points accumulated at that time will be accepted and following the termination date will be converted into rewards in a form to be determined by Metro at its sole discretion.

Account Closure

31. Inactive account. If a card has not been used for purchases or rewards over a period of 18 consecutive months, Metro reserves the right to close the account. Upon written notice sent to the member, all accumulated points linked to the card automatically expire on a given date.

32. Closure by Metro. Metro may, at any time and at its sole discretion, adjust, withdraw or cancel the cards and accumulated points and rewards of members who have, in Metro’s opinion, abused their privileges, refused to comply with Program terms and conditions, made a false statement or did not duly complete and send the enrollment form.

33. Closure by member. Members may cancel their membership in the Program. To do so they need to complete the cancellation form available at the Program’s web site (moiprogram.ca) or Participating Banners’ web site.

Their Program account will be closed within 30 days following receipt of the request to do so. At the end of this period, the card and all other items relating to said Program account will be cancelled. Members must redeem the points in their account before cancelling their membership in the Program. If members do not redeem their points before cancelling their membership in the Program, they will be deemed to have forfeited the accumulated points.

In the event of Program membership cancellation, Metro shall, upon the member’s request, erase from its files all personal information regarding the member, according to the Program’s personal information retention policy, except for any personal information it is required to keep by law. The member can make this request by contacting Customer service at 1 866-638-0020.

General

34. You are responsible for i) maintaining the confidentiality of any passwords granting access to your accounts related to the Program or any other services of Metro, the Participating Banners and participating partners, and ii) safeguarding your card. You must notify us of any unauthorized use of your card or any password.

35. These terms and conditions, and any specific promotion conditions, constitute the entire agreement between the parties hereto and supersede all prior written or oral terms and conditions, statements, proposals, discussions and communications with respect to the subject matter contained herein.
